An employer paying a supported wage to an employee whose disability limits productive capacity and who meets the disability support pension impairment criteria must have capacity assessed by an approved SWS assessor (consulting the employer, employee and, if wanted, a union), document it in a signed SWS wage assessment agreement kept as a time and wages record and lodged with the Fair Work Commission, pay the assessed percentage of the relevant minimum wage but not less than the weekly floor in Schedule E of the current award (consolidated to 1 July 2026, read 30 September 2026), review it annually or on reasonable request, take reasonable steps to adjust the workplace, and limit any trial period to 12 weeks (plus up to 4 weeks of work adjustment) at no less than the floor. Other conditions apply pro rata.
