Redundancy pay is provided by the NES (ss 119 to 123). If redundancy leads to a transfer to lower-paid duties, the employer must give notice as for termination or pay the difference in ordinary pay (including all-purpose allowances, shift and penalty rates) for the notice not given. An employee given redundancy notice may leave during the minimum notice period and still receive the redundancy benefits, though not pay for the unworked notice. The employee must be allowed up to one day off without loss of pay each week of the minimum notice to seek work, and may be asked for proof (a statutory declaration suffices) if more than one day is taken, without which that time is unpaid.
