An education provider with a student with a disability enrolled, or reasonably expecting one, develops and implements strategies and programs to prevent harassment or victimisation of a student with a disability, or of a student who has an associate with a disability, in relation to the disability. Harassment includes action related to the disability that is reasonably likely to humiliate, offend, intimidate or distress (s 8.1). Unjustifiable hardship is not available as an exception to Part 8 (s 10.2(1)). Measures include codes of conduct prohibiting disability harassment (including about adjustments and aids such as wheelchairs, hearing aids, interpreters, carers and assistance animals) and harassment of associates, fair and accountable complaint procedures, and prompt handling proportionate to severity (s 8.5).
