A distributor must take reasonable steps reasonably likely to result in distribution consistent with the TMD, scaled to risk and harm. Complying with the issuer's distribution conditions and agreement is usually not enough on its own. ASIC looks at controls over compliance with distribution conditions, the distribution method, marketing and promotional material, the effectiveness of product governance, inappropriate incentives, training, and how the distributor assesses whether a consumer is likely to be in the target market (Table 6).
