Event data recorders, which can record video and sound around incidents or continuously along with GPS and speed, are lawful only if processing the driver's data is necessary for a legitimate purpose and meets proportionality and subsidiarity. Continuous in-cab recording to improve driving skills is a serious interference that the employer's interest does not outweigh; alternatives such as devices that stop phone use, emergency braking or lane departure systems may be more appropriate, and footage of third parties such as pedestrians cannot rest on the company's interest.
