A registered provider must ensure, so far as is reasonably practicable, that its conduct does not cause adverse effects to the health and safety of individuals while delivering funded aged care services to them. Reasonably practicable weighs the likelihood and degree of harm, what the provider knows or ought to know about prevention, the availability and suitability of preventive measures and the individual's rights, including the right to take personal risks. A serious failure (exposing an individual to a risk of death or serious injury or illness through a significant failure or systematic pattern) is a civil penalty of up to 1,000 penalty units for a body, rising to 4,800 where death, serious injury or illness results; courts may also order compensation.
