A registered provider must use refundable deposits only as section 310 permits and accommodation bonds only as the rules made under paragraph 287(3)(a) permit. Where a non-permitted use is followed within five years by an insolvency event with an outstanding accommodation payment balance, the provider commits an offence (300 penalty units), and a responsible person of a corporate provider who knew or was reckless or negligent about the use, could influence it and failed to take all reasonable steps to prevent it faces imprisonment for 2 years.
