Where the agreement requires the lessor's consent for a renovation, alteration or addition, the tenant applies in writing. For a special modification (a minor modification that can be undone, or work for safety, a health practitioner's disability recommendation, energy efficiency, telecommunications access or security), the lessor may refuse only with ACAT's prior approval and is taken to consent unless it applies to ACAT within 14 days. Other modifications may not be unreasonably refused, and the tenant may seek ACAT review. Consent may carry reasonable conditions, such as using a qualified tradesperson and restoring the premises at the end. Consent to adding fixtures and fittings may not be unreasonably withheld.
