ACT Residential Tenancies Act 1997 s35A-35C: ss 35A to 35C, Sch 1 cls 72A and 72B Co-tenant changes: lessor responses

A co-tenant wanting to leave must ask the lessor and other co-tenants in writing at least 21 days ahead; in a periodic agreement the lessor must not unreasonably refuse and is taken to consent if it neither responds nor applies to ACAT within 21 days. A tenant wanting to add a co-tenant asks in writing at least 14 days ahead; the lessor must not unreasonably refuse, must give the tenant and the new person written reasons for any refusal, and is taken to consent if it does not respond within 14 days. Once a change is agreed the agreement continues with the remaining or new co-tenants, and the lessor must not charge for consenting.
