Western Australia Fair Trading Act 2010
Parts 7 to 9: Criminal and civil proceedings, liability, defences, court orders and miscellaneous – Western Australia Fair Trading Act 2010

Western Australia Fair Trading Act 2010 95: Employers and principals answer for offences by employees and agents unless reasonable diligence could not have prevented them

What does 95 require?

Where an employee or agent is convicted of an offence against the Act, each person who was their employer or principal at the time is also guilty and liable to the same penalty, unless that person proves that reasonable diligence could not have prevented the offence. Where an ACL (WA) offence under Parts 2-1, 2-2 or 3-1 (excluding Divisions 2 and 3 of Part 3-1) was caused by another person's act or default, that other person is also guilty and may be prosecuted whether or not the first person is.
