Western Australia Fair Trading Act 2010
Parts 7 to 9: Criminal and civil proceedings, liability, defences, court orders and miscellaneous – Western Australia Fair Trading Act 2010

Western Australia Fair Trading Act 2010 106-107: Comply with any court order preserving money or property while proceedings are on foot

What does 106-107 require?

When the Minister or the Commissioner applies, the Supreme Court or District Court may order a person against whom proceedings under the Act have been or may be taken, or an associate holding money or property for that person or a wholly owned subsidiary, not to pay money or transfer, sell or dispose of property, where that is necessary to preserve assets to meet a fine, damages, compensation, refund or an order to transfer or return property, and the order would not unduly prejudice others. Contravening or failing to comply with such an order is a crime carrying a fine of up to 1 100 000 dollars for a body corporate and 220 000 dollars for an individual.
