A person who commits an offence against the ACL (WA), or who is involved in it by aiding, abetting, counselling, procuring, inducing, being knowingly concerned in, conspiring to commit or attempting it, is guilty of a crime carrying the penalty set out in the ACL (WA), with a lower summary conviction penalty. Pecuniary penalty proceedings under ACL (WA) section 224 are heard under the civil rules of evidence and procedure. Where the ACL (WA) is inconsistent with the Sale of Goods Act 1895, the ACL (WA) prevails despite any agreement.
