Western Australia Fair Trading Act 2010
Part 3: The Australian Consumer Law as a law of Western Australia – Western Australia Fair Trading Act 2010

Western Australia Fair Trading Act 2010 19-24: Comply with the Australian Consumer Law (WA) as the applied law of the State, wherever the conduct occurs

What does 19-24 require?

The Australian Consumer Law text applies as a law of Western Australia, called the ACL (WA), and so far as it is Schedule 2 it is part of this Act. It binds persons carrying on business within the State, bodies corporate incorporated or registered under WA law, persons ordinarily resident in the State and persons otherwise connected with it, and extends to conduct and matters occurring wholly or partly outside the State, within or outside Australia. A trader connected with Western Australia must therefore meet the ACL's consumer guarantees, unfair practices, unfair contract terms, product safety and information standard requirements under State enforcement as well as Commonwealth enforcement.
