Virginia CDPA 59.1-577.1 B: Age screening and one hour daily limit for users under 16

What does 59.1-577.1 B require?

Controllers or processors operating a social media platform (as defined, excluding services mainly for messaging, news, sports, entertainment, ecommerce or gaming) must use commercially reasonable methods such as a neutral age screen to find users under 16, limit such minors to one hour per day per service or application, and let a parent give verifiable parental consent to raise or lower the limit. Status: enacted by 2025 c. 703 with effect from 1 January 2026; enforcement was preliminarily enjoined by the federal court in NetChoice v. Jones (E.D. Va., 27 February 2026), and the Attorney General has appealed. See the official text for the full requirement.
