Victoria Owners Corporations Act 2006
Part 10: Lot owners, occupiers and rules (including retirement villages) – Victoria Owners Corporations Act 2006

Victoria Owners Corporations Act 2006 138-141: Rules: special resolution, Schedule 1 subject matter, model rules, invalid rules and who is bound

What does 138-141 require?

By special resolution an owners corporation may make, amend or revoke rules on the matters in Schedule 1 (health and safety, use of common property and lots, behaviour, vehicles and parking, pets, short-stay accommodation and other listed matters), for the control, management, administration, use or enjoyment of the common property or a lot. Rules may also address proxies (section 138A) and external alterations (section 138B). The model rules in the regulations apply where no rules are made or where the rules are silent on a matter. A rule is of no effect if it is oppressive, unfairly prejudicial or unfairly discriminatory, or inconsistent with the Act, the Subdivision Act 1988, the regulations or any other law. The rules bind the owners corporation, lot owners, lessees, sub-lessees and occupiers.
