To check compliance with the Act or regulations, or to investigate a suspected contravention, the Authority may serve a written notice requiring a person to supply the information it asks for or to produce a document the person holds or controls. The person served must comply unless they have a reasonable excuse. Failing or refusing to comply carries a maximum of 60 penalty units (individual) or 300 penalty units (body corporate). A notice addressed to an individual must tell them they may decline to give information that would tend to incriminate them. Knowingly giving materially false or misleading information is a separate offence under s 153.
