Victoria Occupational Health and Safety Act 2004 s16: s 16 Do not contravene an enforceable undertaking given to the Authority

The Authority may, by written notice, accept a written undertaking that a person offers about an actual or alleged contravention of the Act or regulations. Any withdrawal or variation by the person needs the Authority's consent in writing. A person who has given an undertaking must not breach it: the maximum penalty is 500 penalty units (individual) or 2500 penalty units (body corporate). No prosecution by the Authority or an inspector may be brought for the covered contravention while the undertaking is in force, or after it has been fully met and discharged (s 16(4)). If the Authority considers the undertaking has been breached it may apply to the Magistrates' Court, which may order compliance, order specified action to comply, or make any other order it thinks fit (s 17).
