Victoria Occupational Health and Safety Act 2004 s39G-2: s 39G(2) Officers: do not engage in negligent conduct causing death through the entity's breach

An officer (other than a volunteer) of an applicable entity, meaning a body corporate, an unincorporated body or association, or a partnership, including one that represents the Crown, is prohibited from negligent conduct that both breaches an applicable duty owed by the entity to someone else and causes that person to die. Maximum penalty: imprisonment for 25 years. The offence is indictable and cannot be heard and determined summarily (s 39G(3) and (4)).
