Victoria Occupational Health and Safety Act 2004 s39G-1: s 39G(1) Do not engage in negligent conduct that breaches an applicable duty and causes death

Any person other than a volunteer is prohibited from negligent conduct that both breaches an applicable duty (a Part 3 duty, see s 39B) they owe to someone else and causes that person to die. Maximum penalty: 25 years imprisonment (individual), and 100 000 penalty units (body corporate). The offence is indictable and, unlike other indictable offences in the Act, cannot be heard and determined summarily (s 39G(4)).
