Victoria Occupational Health and Safety Act 2004 s148B-4: s 148B(4) Do not provide a benefit under a penalty insurance or indemnity term

A person must not give another person a benefit under a contract or arrangement term that claims to cover that other person, by insurance or indemnity, for liability for a pecuniary penalty under the Act or regulations. Maximum penalty: 300 penalty units for an individual, 1500 for a body corporate; indictable but may be heard summarily. This binds insurers, principals and employers who might otherwise pay a penalty on someone's behalf.
