US Section 504 of the Rehabilitation Act (29 USC 794) and HHS Rule 45 CFR Part 84 84.23: Design new construction and alterations to be readily accessible, meeting the 2010 Standards for work commenced from 9 May 2025 (UFAS or the 2010 Standards in the transition window)

What does 84.23 require?

Each facility or part of a facility constructed by, on behalf of or for the use of a recipient must be designed and constructed to be readily accessible to and usable by individuals with disabilities, and each alteration affecting usability must to the maximum extent feasible make the altered part accessible. Public-entity recipients comply through the ANSI A117.1-1961 standard for construction commenced between June 1977 and January 1991, UFAS from January 1991 to 8 July 2024, UFAS or the 2010 Standards for work commenced between 8 July 2024 and 9 May 2025, and the 2010 ADA Standards for Accessible Design for work commenced on or after 9 May 2025; private-entity recipients apply the same standards by the date of the last building permit application (or the start of construction where no permit is required). Departures from a standard are permitted only where equivalent access is clearly provided. Ceremonial groundbreaking does not commence construction.
