No qualified individual with a disability may, on the basis of disability, be subjected to discrimination in employment under any program or activity receiving HHS assistance. Whether the prohibition has been violated is determined by the standards of title I of the Americans with Disabilities Act and, as they relate to employment, sections 501 to 504 and 511 of the ADA, as implemented by the EEOC regulation at 29 CFR Part 1630: reasonable accommodation absent undue hardship, limits on disability-related inquiries and medical examinations, qualification standards that are job-related and consistent with business necessity, and no retaliation.
