Disclosure obligation (paragraph (a)(2)(i)) – US SEC Regulation Best Interest (17 CFR 240.15l-1)

US SEC Regulation Best Interest (17 CFR 240.15l-1) a2i-A1: Disclose the capacity in which the recommendation is made

What does a2i-A1 require?

Among the material facts about the relationship, the firm must tell the retail customer that it is dealing with them in a brokerage capacity, or that the individual is an associated person of a brokerage firm, for that recommendation. Dually registered firms and individuals must make clear which hat they wear for that recommendation, since the duties differ between brokerage and advisory capacities.
