US SEC Digital Assets and Crypto Regulatory Framework INT-V: Keep mining and staking arrangements within the described conditions so they are not securities transactions

What does INT-V require?

Interpretation Section V: protocol mining (solo or pooled) and protocol staking (solo, self-custodial with a node operator, custodial and liquid staking) of digital commodities, including ancillary services (slashing coverage, early unbonding, alternative reward timing, aggregation), are administrative or ministerial and not securities transactions, provided the arrangement matches the release: the custodian or liquid staking provider does not decide whether, when or how much to stake, does not use deposited assets for business purposes, lending, pledging or rehypothecation, and does not fix or guarantee rewards beyond those the protocol pays; staking receipt tokens are not securities only when the underlying asset is not a security or subject to an investment contract.
