US SBA SOP 50 10 8.1 Lender and Development Company Loan Programs A4-D8: Section A Ch 4 Para D.8: Disclosure of fees on SBA Form 159 (7(a))

The 7(a) Lender records in the SBA Loan System whether it charged fees (and how much) and whether any Agent was involved, with the Agent's name and full address. For every Agent not working under an SBA-reviewed LSP agreement, whoever pays it, it completes SBA Form 159 per the instructions (separate forms per Agent and per application, each service separately itemized, in-kind compensation itemized, an itemization and support attached where an Agent's aggregate fees exceed the threshold, the Lender signing twice when also acting as Agent), signed by the Applicant, Agent and Lender; uploads it with supporting documents within two SBA Form 1502 reporting cycles of initial disbursement; and keeps the original signed form. Accountants preparing ordinary financial statements, appraisers, valuation Qualified Sources, environmental professionals, closing attorneys, real estate agents and reviewed LSPs are not Agents for this purpose.
