US No Surprises Act (42 USC 300gg-111 to 300gg-139) and 45 CFR Part 149 149.520: For air ambulance disputes the certified IDR entity must weigh the air-ambulance-specific factors and report the air ambulance determinations monthly

What does 149.520 require?

Air ambulance IDR follows 149.510, but in choosing between offers the certified IDR entity must, in addition to the QPA, consider credible information submitted on the provider's quality and outcomes measures, the acuity of the patient and complexity of the transport, the training and experience of the medical personnel, the vehicle type and clinical capability, the population density of the point of pick-up (urban, suburban, rural, frontier), and the parties' good faith efforts to contract and any contracted rates over the previous 4 plan years, giving no weight to information that is not credible, does not relate to the offers or is already reflected in the QPA. Within 30 business days of each month's end the entity must report the air ambulance initiations, determinations, amounts above the QPA and the other listed data.
