Within 10 business days after the certified IDR entity is selected each party must submit its offer for the out-of-network rate for each item or service, expressed as a dollar amount and as a percentage of the QPA, together with information about the party's size, practice specialty, coverage type and the QPA, and may submit credible information about the provider's training and quality, market share, patient acuity, teaching status, scope of services, good faith network negotiation efforts and prior contracted rates; the entity must not consider usual and customary charges, billed charges or public payer rates. The entity selects one of the two offers within 30 business days, considering the QPA and the credible information, and issues a written decision; the losing party pays the entity fee; the prevailing offer must be paid within 30 calendar days of the determination; and the initiating party may not bring the same item or service against the same party to IDR again within 90 calendar days of the determination.
