Provider, facility and air ambulance duties: balance billing, notice and consent, disclosure (45 CFR 149.410 to 149.450; 42 U.S.C. 300gg-131 to 300gg-139) – US No Surprises Act (42 USC 300gg-111 to 300gg-139) and 45 CFR Part 149

US No Surprises Act (42 USC 300gg-111 to 300gg-139) and 45 CFR Part 149 149.430(c)-(f): Post the disclosure on the website home page and on a prominent sign, and hand each covered patient a one-page notice no later than the request for payment or the claim

The disclosure (or a link to it) must appear on a searchable homepage of the provider's or facility's website; must be posted on a sign prominently displayed at the location (providers without a public location are exempt from the sign); and must be given to each covered patient as a one-page double-sided notice in print no smaller than 12 point, in person, by mail or by email as the patient selects, no later than the date and time payment is requested from the patient or, if none is requested, the date the claim is submitted to the plan. A provider who furnishes services only outside facilities is exempt; a provider furnishing services at a facility satisfies the sign and notice duties where a written agreement makes the facility responsible, in which case the facility alone is liable for a failure.
