US No Surprises Act (42 USC 300gg-111 to 300gg-139) and 45 CFR Part 149 149.420(h)-(i): Retain non-emergency notice and consent documents for 7 years and notify the plan, with a copy of the consent, that the service was furnished at a participating facility

A participating facility that obtains a written consent for its nonparticipating providers must retain the notice and consent for at least 7 years after the service; a provider that obtains the consent itself must either coordinate retention with the facility or retain it for 7 years. For every item or service furnished by a nonparticipating provider at a participating facility, the provider or facility must timely notify the plan or issuer that the item or service was furnished during such a visit and, where consent was obtained, send a copy of the signed notice and consent; where the provider bills the patient directly as permitted, the notice may accompany the bill.
