US ITAR and EAR - Export Control and Data Security ITAR 125.2(c) and 125.1(c): Obtain authorisation before disclosing technical data to foreign persons in any form

Unless an exemption applies, a licence is needed for the oral, visual or documentary disclosure of technical data by U.S. persons to foreign persons, however it is transmitted (in person, telephone, correspondence or electronic means), including disclosures during visits to foreign diplomatic missions and consulates (125.2(c)). Technical data authorised for export may not be reexported, transferred, diverted from the authorised end user or country, or disclosed to a national of another country without DDTC's prior written approval (125.1(c)), and a technical data licence or exemption may not be used for foreign production or technical assistance without approval, generally through a Part 124 agreement (125.1(b)).
