US ITAR and EAR - Export Control and Data Security ITAR 122.1-122.3: Register with DDTC before manufacturing, exporting or furnishing defense services, and keep registration current

What does ITAR 122.1-122.3 require?

Anyone who engages in the United States in the business of manufacturing, exporting or temporarily importing defense articles or furnishing defense services must register, and one occasion is enough; a manufacturer that never exports must still register (122.1(a)). Exemptions cover U.S. Government staff, persons whose business is confined to producing unclassified technical data, AEA-licensed activity and fabrication solely for experimental or scientific purposes, but those exempt from registration still need licences and cannot receive one unless registered (122.1(b)). The DS-2032 statement is signed by an empowered U.S.-person senior officer, may cover subsidiaries and affiliates, must certify indictments, convictions, ineligibility and foreign ownership or control (122.2(a)-(b)), and must be renewed annually 30 to 60 days before expiry with the tiered fee (122.2(d)-(e), 122.3). There is no EAR registration equivalent.
