Controlled information is defined differently in each regime. ITAR technical data is information (other than software) required for the design, development, production, manufacture, assembly, operation, repair, testing, maintenance or modification of defense articles, including drawings, photographs, plans and instructions; classified information on USML and 600-series items; information under an invention secrecy order; and software directly related to defense articles. It excludes general scientific, mathematical or engineering principles commonly taught in schools, public-domain information, certain telemetry data and basic marketing information on function or purpose or general system descriptions (120.33). EAR technology is information necessary for the development, production or use (and operation, installation, maintenance, repair, overhaul or refurbishing) of an item, in any tangible or intangible form including information revealed by visual inspection, with the controlled scope set by the General Technology Note and the CCL (772.1).
