US Form I-9 Employment Eligibility Verification (8 USC 1324a and 8 CFR Part 274a) 274a.5: Do not use contracts, subcontracts or labor exchanges to obtain the labor of an alien you know to be unauthorized

What does 274a.5 require?

Any person or entity that uses a contract, subcontract or exchange entered into, renegotiated or extended after 6 November 1986 to obtain the labor or services of an alien in the United States, knowing the alien is unauthorized, is treated as having hired the alien in violation of section 274A(a)(1)(A). The rule reaches staffing arrangements, labor contractors and independent contractor engagements where the user knows the worker lacks authorization, even though the contractor is the employer for Form I-9 purposes.
