US Form I-9 Employment Eligibility Verification (8 USC 1324a and 8 CFR Part 274a) 1324b(a)(6): Do not request more or different documents than required, reject documents that reasonably appear genuine, or treat employees differently in verification because of citizenship status or national origin

What does 1324b(a)(6) require?

It is an unfair immigration-related employment practice for a person or entity, for the purpose or with the intent of discriminating on the basis of citizenship status or national origin, to request more or different documents than section 274A requires, or to refuse to honor documents tendered that on their face reasonably appear genuine; employers also may not treat groups of employees differently in completing, reverifying or auditing Forms I-9 or in using E-Verify, or prefer United States citizens unless law, regulation or government contract requires it. The Immigrant and Employee Rights Section of the Department of Justice enforces these rules with civil penalties and back pay.
