US Foreign Corrupt Practices Act (FCPA) B-3: Keep facilitating payments and hospitality within the narrow exception and affirmative defences

What does B-3 require?

The prohibition does not reach facilitating or expediting payments for routine, non-discretionary governmental action, and it is a defence that a payment was lawful under the foreign country's written laws or was a reasonable and bona fide expenditure, such as travel and lodging, directly related to promoting or demonstrating products or services or performing a government contract; companies bear the burden of proving a defence, and many ban facilitating payments outright.
