US Federal Motor Carrier Safety Regulations (49 CFR Parts 350 to 399) 392.1-16: Driving rules: compliance with State and local laws, ill or fatigued operator, drugs and alcohol prohibitions (including the four-hour rule), schedules that would require speeding, seat belt use and equipment and load checks (392.1 to 392.16)

What does 392.1-16 require?

Every CMV must be operated in accordance with the laws of the jurisdiction in which it is operated, with the FMCSRs prevailing where stricter (392.2). No driver may drive a CMV, and no carrier may make a driver do so, when illness, fatigue or anything else has impaired the driver's ability or alertness (392.3). No driver on duty may have, use or be affected by any Schedule I drug, amphetamine, narcotic or other substance that renders the driver incapable of safe driving (392.4), or use or be under the influence of alcohol within four hours before going on duty or driving, or possess alcohol other than manifested cargo (392.5), with an out-of-service period of 24 hours for a measured alcohol concentration or possession. The carrier may not schedule a run that would require speeds exceeding the limits (392.6). The driver must satisfy themselves that the service brakes, parking brake, steering, lights, tires, horn, mirrors, coupling devices and emergency equipment are in good working order before driving (392.7), that the cargo is properly distributed and secured and inspected within the first 50 miles and every 150 miles or three hours thereafter (392.9), must use the seat belt (392.16), and must stop at railroad crossings where required (392.10, 392.11).
