An implied nutrient content claim (a statement that a food contains, or is made from, an ingredient associated in the public mind with a nutrient, or that suggests the food is useful in maintaining healthy dietary practices in connection with a nutrient) is permitted only where the food meets the definition for the related express claim. 'Healthy' and derivatives may be used only on foods that meet the updated 101.65(d) criteria: a food must contain a specified amount of a food group (vegetables, fruits, grains, dairy, protein foods) per RACC and must not exceed the limits for saturated fat, sodium and added sugars set for its category, with water, raw whole fruits and vegetables qualifying automatically (compliance date February 2028 for the 2024 revision, with the prior criteria available until then). 'Fresh' may be used only on raw food that has not been frozen, heat processed or otherwise preserved (with exceptions for approved waxes, pesticides, mild chlorine or acid washes and ionising radiation under 1 kGy), and 'fresh frozen' for food quickly frozen while fresh. Firms may petition under 101.69 for new claims or synonyms.
