Subparts D and E: Nutrient content claims and health claims – US FDA Food Labeling Regulations (21 CFR Part 101)

US FDA Food Labeling Regulations (21 CFR Part 101) 101.54-62: Defined nutrient content claims: 'good source', 'high', 'more' (101.54); 'light' (101.56); calories ('calorie free', 'low calorie', 'reduced calorie', 'sugar free', 'no added sugars') (101.60); sodium ('sodium free', 'very low sodium', 'low sodium', 'reduced sodium') (101.61); fat, fatty acid and cholesterol ('fat free', 'low fat', 'reduced fat', 'saturated fat free', 'cholesterol free', 'lean', 'extra lean') (101.62)

What does 101.54-62 require?

Each defined claim has quantitative criteria per RACC (and per 50 g for small RACC foods): 'good source' or 'contains' means 10 to 19 percent of the Daily Value and 'high', 'rich in' or 'excellent source' at least 20 percent; 'more' means at least 10 percent of the DV more than the reference food; 'light' means one-third fewer calories or 50 percent less fat than the reference food (or 50 percent less sodium in a low-calorie, low-fat food); 'calorie free' fewer than 5 calories, 'low calorie' 40 or fewer, 'sugar free' less than 0.5 g sugars with a 'not a low calorie food' statement where applicable, 'no added sugars' only where no sugars are added during processing and the food is not inherently sugar-free; 'sodium free' less than 5 mg, 'very low sodium' 35 mg or less, 'low sodium' 140 mg or less; 'fat free' less than 0.5 g, 'low fat' 3 g or less, 'saturated fat free' under 0.5 g saturated fat and under 0.5 g trans fat, 'low saturated fat' 1 g or less and 15 percent or less of calories, 'cholesterol free' less than 2 mg and 2 g or less saturated fat, 'low cholesterol' 20 mg or less, and 'lean' and 'extra lean' for meat, poultry, seafood and game by fat, saturated fat and cholesterol per 100 g. Reduced and less claims require at least 25 percent less than the reference food.
