Subpart B: Specific food labeling requirements (flavors, colors, juice, dietary supplements) – US FDA Food Labeling Regulations (21 CFR Part 101)

US FDA Food Labeling Regulations (21 CFR Part 101) 101.22: Spices, flavorings, colorings and chemical preservatives: 'artificially flavored' and 'with other natural flavor' labeling, the natural and artificial flavor definitions, colors declared by name (certified colors such as FD&C Yellow No. 5) and the 'color added' designation, preservative function statements, and the flavor supplier certification (101.22)

What does 101.22 require?

The label must declare spices, natural flavors and artificial flavors as such in the ingredient statement, and where a characterising flavor is artificial or where the food contains an artificial flavor simulating the characterising flavor, the name of the food on the PDP must be accompanied by 'artificial' or 'artificially flavored' (or 'natural and artificial', or 'with other natural flavor' where natural flavor other than the characterising one is added) in letters not less than half the height of the name. Certified color additives must be declared by their name (for example 'FD&C Yellow No. 5' or 'Yellow 5'), and non-certified colors may be declared by name or as 'artificial color', 'color added' or similar; chemical preservatives must be declared by common name followed by their function ('to preserve freshness', 'a preservative'). A flavor supplier must certify to the food manufacturer that its flavor complies and may keep its formula confidential, and the manufacturer may rely on the certification. Incidental additives and processing aids at insignificant levels need not be declared.
