Uruguay DPL 18: Sensitive data and data on offences

What does 18 require?

No one may be compelled to provide sensitive data (racial and ethnic origin, political preferences, religious or moral convictions, trade union membership, health, sexual life), which may be processed only with the data subject's express written consent, or where reasons of general interest authorised by law apply or the requesting body has a legal mandate, or for statistical or scientific purposes when dissociated; forming databases that directly or indirectly reveal sensitive data is prohibited, except for political parties, unions, churches, religious confessions, associations, foundations and other non-profit entities with a political, religious, philosophical or union purpose, or referring to racial or ethnic origin, health or sexual life, as to their members, with communication always requiring prior consent; data on criminal, civil or administrative offences may be processed only by the competent public authorities under their laws, without preventing authorities from publishing the identity of persons investigated for or having committed infringements where other rules impose or permit it.
