Every commercial email must give clear and conspicuous notice of the right to opt out and contain a functioning return email address or other Internet-based mechanism, clearly displayed, that the recipient can use to ask not to receive further commercial email from the sender, and that keeps working for at least 30 days after the message is sent. A preference menu is allowed if it includes an option to stop all commercial email from the sender; a temporary technical outage corrected within a reasonable time is not a breach.
