Part 3 Chapters 4 and 5: children's access assessments and fraudulent advertising – UK Online Safety Act 2023

UK Online Safety Act 2023 s.36: Children's access assessments

What does s.36 require?

Every Part 3 service carries out a suitable and sufficient children's access assessment, recorded in writing, deciding whether children are able to reach the service or any part of it (they are, unless age verification or estimation normally keeps them out) and whether the child user condition is met (a significant number of child users or a service likely to attract significant numbers of children). Services not treated as likely to be accessed by children reassess at least yearly, before relevant significant changes, and on evidence of weaker age assurance or more child users. A service that fails to do the first assessment is treated as likely to be accessed by children (s.37). In force: first assessments due by 16 April 2025.
