Part 3 Section 1: fitness of providers, directors, nominated individuals and registered managers (regulations 4 to 7, Schedules 3 and 4) – UK Health and Social Care Act 2008 (Regulated Activities) Regulations 2014 (CQC Fundamental Standards)

UK Health and Social Care Act 2008 (Regulated Activities) Regulations 2014 (CQC Fundamental Standards) 4: An individual or partnership may carry on a regulated activity only if fit: good character, health, Schedule 3 information and the necessary qualifications, competence, skills and experience

What does 4 require?

A service provider that is an individual must not carry on a regulated activity unless fit to do so, and a partnership unless each partner is fit and the partnership as a whole has the necessary attributes. Fitness requires that the individual or each partner is of good character (assessed against the matters in Part 2 of Schedule 4: convictions in the United Kingdom or elsewhere, and erasure, removal or striking off from a professional register), is able by reason of health, after reasonable adjustments, to perform the tasks intrinsic to the activity or to their role, and can supply or arrange the availability of the Schedule 3 information; and that the individual, or the partners in combination, have the necessary qualifications, competence, skills and experience to carry on the activity.
