UAE Virtual Asset Regulatory Authority (VARA) Regulations CO-IV.F: Company Rulebook IV.F and IV.G: Cross-border outsourcing and audit rights

What does CO-IV.F require?

For providers outside the UAE, weigh the country's conditions, legal system, infrastructure and reputational risk, do extra due diligence on data protection, monitoring, continuity and exit, comply with data transfer laws, consider informing clients, tell VARA and clients of overseas authority access requests, and notify VARA before any cross-border outsourcing without impeding its access and audit rights. All agreements must let the firm review the function and preserve authorities' powers; material agreements must give the firm and authorities full access to premises, systems, data, personnel and auditors and unrestricted inspection rights, with pooled audits and third-party certifications usable only after assessing their scope and currency.
