For state fire marshal inspections the Commissioner adopts by reference the NFPA 1 Fire Code and the NFPA 101 Life Safety Code in the editions the section names, with exclusions: the administrative provisions of NFPA 1 chapter 1 on enforcement, authority, incident command, liability, boards of appeal, records, permits, certificates of fitness, plan review and notices do not apply to state inspections; the motor fuel dispensing chapter yields to Subchapter A and Health and Safety Code chapter 753 where they conflict; the hazardous materials chapter and other listed chapters yield to the stated Texas statutes and rules. Owners and operators of state-owned, state-leased and other inspected buildings are therefore measured against those codes as adopted, and corrections are expected to follow the inspection report.
