Tasmania Child and Youth Safe Organisations Act 2023 s35: Investigate, or engage an independent investigator, and report findings

As soon as practicable after becoming aware, the head investigates the reportable allegation or conviction or engages an independent investigator with appropriate qualifications, training or experience, and tells the Regulator who is investigating (s 35(1)); if unable or unwilling to investigate, the head notifies the Regulator with reasons (s 35(2)), which may lead to investigation by the Regulator or the entity regulator (ss 24, 36). The investigation is completed even if the worker leaves (s 35(3)). On completion the head gives the Regulator the findings and reasons, details and reasons of disciplinary or other action taken or proposed, or reasons why no action will be taken (s 35(4)).
