When a complaint is lodged, the information officer or head of the private body concerned may respond in writing to the Regulator, and under the Regulations must respond and submit the documents on which the decision was based within 20 working days of receiving the complaint. The Regulator may assess, on its own initiative or on request, whether a body's PAIA policies and procedures comply (the body is invited to show why an assessment is unnecessary), serve information notices requiring specified information within a set period, and, after its Enforcement Committee's recommendation, serve enforcement notices confirming, amending or setting aside the decision or requiring action. Refusing to comply with an enforcement notice is an offence punishable by a fine, up to three years' imprisonment or both; a body may, in the cases section 78(4) allows, apply to court within 180 days against the Regulator's decision. Public body officials must give the Regulator reasonable assistance, and a private body head may on request give it information on requests received.
