Sections 21 to 26: Prohibitions, sale of articles, deductions, reporting of incidents and diseases, victimisation – South Africa Occupational Health and Safety Act 85 of 1993

South Africa Occupational Health and Safety Act 85 of 1993 26: Victimisation forbidden: no dismissal, pay reduction, worse terms or disadvantage because an employee gave information to the Minister or an official, complied with an inspector, gave evidence, exercised or refused to breach the Act, or because of medical surveillance results or a disease report

What does 26 require?

No employer dismisses an employee, reduces their remuneration, alters their terms and conditions to their detriment or alters their position relative to other employees to their disadvantage because, or on the suspicion or belief, that the employee gave information to the Minister or a person administering the Act that they were required to give or that concerns the terms, conditions or circumstances of employment, complied with an inspector's lawful prohibition, requirement, request or direction, gave evidence before a court or the industrial court, did anything the Act permits or requires or refused to do anything it prohibits. Nor may an employer unfairly dismiss, reduce pay or worsen the position of an employee because of information obtained from listed-work monitoring and surveillance results under section 12(2) or a medical practitioner's disease report under section 25.
