Singapore Consumer Protection (Fair Trading) Act 2003
Part 4: contracting out, documents and burden of proof – Singapore Consumer Protection (Fair Trading) Act 2003

Singapore Consumer Protection (Fair Trading) Act 2003 41: Burden of proving compliance with specified requirements rests on the supplier

What does 41 require?

In court proceedings between a consumer and a supplier about a consumer transaction, where a dispute arises over whether the supplier complied with any requirement of the Act or regulations specified by the Minister, the supplier must prove that it complied. Suppliers therefore need records that positively demonstrate compliance with prescribed notice, information and contract requirements, not merely an absence of complaints.
