If neither repair nor replacement can be required (impossible or disproportionate), or the transferor has failed to repair or replace within a reasonable time and without significant inconvenience, the consumer may require an appropriate reduction in the price or rescind the contract for the goods. On rescission any reimbursement may be reduced for the use the consumer has had of the goods since delivery. A consumer who has asked for repair or replacement must allow a reasonable time before rejecting the goods or switching remedy (section 17). Courts, including the Small Claims Tribunals, may order specific performance of the repair or replacement duty, substitute the remedy they consider appropriate, and set terms as to damages and payment (section 18).
